Purchasing a unique artwork
2 Entering into a contract with me
2.1 When you place an order you are demonstrating an intent to buy goods. This involves payment. I will send you an email confirming that I have received your order and payment.
2.2 Once payment has been successfully received, I will notify you that the order has been processed. At this point, a contract exists between us.
2.3 Colours displayed on this website may differ from the real painting due to monitor settings. I will represent artworks as accurately as technology allows.
2.4 All information is approximate and provided in good faith.
2.5 Any contract we enter into will be governed by Swiss law, unless otherwise required by mandatory local consumer laws.
2.6 By placing an order and paying for your goods, you agree to these terms.
3 How to buy something
3.1 You can place an order via the website by selecting the product and adding it to your cart. Items can be removed at any time. Orders may also be placed by telephone: +41 76 779 49 78.
3.2 Shipping charges will be given after committing to purchase and you will receive a separate invoice by email.
3.3 Full payment is required at the time of ordering.
3.4 Secure online payment facilities are used.
3.5 For non-Portuguese countries, import charges may apply and are the responsibility of the buyer.
3.6 Once the order is complete, I will notify you of the dispatch date (normally 7–10 days after checkout).
4 Delivery & Shipping Charges
4.1 Goods are normally dispatched from my studios within 10–14 working days.
4.2 A carrier will normally deliver goods within 2–3 working days in Europe and 5–8 days overseas.
4.3 Goods are delivered to the address provided in your order. You must be home to accept delivery. I am not responsible for loss or damage if delivery is left unattended.
4.4 Disposal of packing materials is your responsibility.
4.5 After two failed delivery attempts, goods may be returned to my studio where I reserve the right to charge a re-delivery fee.
4.6 If the delivery address changes after dispatch, additional charges may apply.
4.7 Please check goods on delivery. Any damage should be reported to the delivery driver or to me promptly.
4.8 If goods are lost or damaged in transit, please notify me immediately.
4.9 Delivery may be prevented by circumstances beyond my control, including accidents, fire, flood, severe weather, acts of God, war, riot, civil commotion, malicious damage, or supplier defaults.
5 Cancellation and returns (Artworks)
5.1 You can cancel your contract up to 14 days after delivery by email to studio@philippmettler.com
or in writing. Phone cancellations are not accepted.
5.2 No reason is required for cancellation, though a brief explanation helps improve service.
5.3 Goods must be returned within 14 days of cancellation, complete with original packaging and at your own expense. Proper care must be taken to avoid damage.
5.4 You may examine the goods for 14 days as if visiting my studio.
5.5 If goods are not returned or are damaged due to negligence, costs will be charged accordingly.
5.6 Refunds (including postage/carriage) will be issued within 30 days, less any agreed costs.
5.7 Business customers or those exempt from distance selling regulations may not cancel without agreement. Legal rights regarding faulty or misdescribed goods are unaffected.
6 Faulty Goods / Guarantee (Artworks)
6.1 Problems with goods must be reported by email or in writing, ideally with a photograph.
6.2 Exchanges will be arranged without unreasonable delay. Replacement goods are dispatched after receipt of the original. Return postage is the customer’s responsibility unless the goods are found faulty. Reasonable postage costs for faulty items will be refunded. Non-faulty returns are sent back at the customer’s expense.
7 Creative Programmes in Kuala Lumpur, Malaysia
7.1 Description of the Programme
7.1.1 Location: The RTC, 20 Jalan Horley, Imbi, 55100 Kuala Lumpur, Malaysia.
7.1.2 Includes guidance by Philipp Mettler, use of all painting materials, and co-creation of a large-scale abstract artwork tailored to the chosen size and colour palette.
7.1.3 No prior art experience required.
7.1.4 Group sizes: 1-to-1 or up to 5 participants.
7.2 Booking, Payment & Pricing
7.2.1 Bookings via WhatsApp, email, phone, or enquiry form.
7.2.2 Full payment required at booking unless agreed otherwise.
7.2.3 Prices are in Malaysian Ringgit (RM).
7.2.4 Corporate invoices may be issued to Swiss or Malaysian entities.
7.3 Cancellation Policy (Services)
7.3.1 ≥14 days notice: full refund.
7.3.2 7–13 days notice: 50% refund.
7.3.3 <7 days notice: no refund.
7.3.4 Rescheduling possible up to 7 days before session, subject to venue availability.
7.3.5 Cancellations must be by email.
7.4 Programme Day & Responsibilities
7.4.1 Sessions normally start 10:00 AM and finish when the painting is completed.
7.4.2 Participants must follow all safety instructions.
7.4.3 Client ensures participants arrive on time.
7.4.4 Protective clothing provided; participants may wear own paint-friendly attire.
7.5 Final Artwork
7.5.1 Artwork becomes the client’s property once fully dried and collected.
7.5.2 Drying times vary depending on size and medium.
7.5.3 Transport or installation is client’s responsibility unless included in the selected package.
7.6 Venue, Safety & Conduct
7.6.1 Programme held at a professional workspace.
7.6.2 Sessions may be halted if participant behaviour endangers safety or property; no refund in such cases.
7.6.3 Special requirements (allergies, mobility, etc.) must be communicated in advance.
7.7 Compliance with Malaysian Law
7.7.1 Sessions conducted as temporary artistic services by a Swiss visiting artist.
7.7.2 Activities comply with Malaysian venue and safety regulations.
7.7.3 Applicable Malaysian taxes will be handled according to local law.
7.8 Liability for Services
7.8.1 Reasonable care is taken to provide a safe, enjoyable session.
7.8.2 Not liable for accidents from failure to follow instructions, damage to personal items, delays due to venue issues, weather, or events beyond control
7.8.3 Liability limited to booking payment as allowed under Swiss and Malaysian law.
7.9 Photography & Media
7.9.1 Photos/videos may be used for promotion with consent.
7.9.2 Clients may opt out before or during the session.
7.10 Certificate of Authenticity: Certificate includes: title, description, date, location, uniqueness confirmation, and Philipp Mettler’s signature.
7.11 Corporate Themes & Brand Alignment: Themes, colours, or brand concepts can be incorporated upon request. Additional planning fees may apply.
8 General Provisions
8.1 Terms may be updated on the website.
8.2 Malaysian programmes are subject to local consumer protections in addition to Swiss law.
8.3 If any clause is unenforceable under Swiss or Malaysian law, remaining clauses remain valid.
